Summary:

This report provides the EPA’s advice to the Minister for the Environment under section 16(e) of the EP Act. The outcome of the EPA’s review of Statement 519 is that the environmental conditions are not required because:

(a) provisions reflecting the requirements of the conditions in Statement 519 are included in Amendment 104 (as modified); and

(b) the extent of the land to be rezoned in Amendment 104 (as modified) has been reduced. Relevant environmental factors such as caves (Ministerial Condition 7) and wetlands (Ministerial Condition 9) are no longer present within the area which is the subject of Amendment 104 (as modified).

Happy Valley Titanium Minerals Project

Summary: This report provides the Environmental Protection Authority’s advice and recommendations to the Minister for Environment on Bemax Resources Limited’s proposal to develop a mineral sand mining proposal that is located in the Shire of Capel on the Whicher Scarp, 10 km south of the town of Boyanup. The two deposits (northern and southern) contain over 750,000 tonnes of recoverable heavy mineral concentrate and will be mined using open cut, dry mining techniques involving heavy earthmoving equipment and processed through screening and separation plants. This proposal will involve the clearing of 146 ha of native vegetation.

Pemberton Sawmill Noise Regulation 17 Variation

Summary: The basis of the application is that, given the fact that the town of Pemberton was originally a timber mill town and therefore has houses in close proximity to the sawmill, the noise emission from the mill has never been able to comply with the prescribed standards of the noise regulations. Though it has been identified that it is practicable to further reduce the noise emissions from several equipment items, and Auswest has committed to implement these controls, Auswest believes that the noise emission from the Pemberton Sawmill operation cannot reasonably or practicably comply with the noise regulations.

Wagerup Alumina Refinery Noise Regulation 17 Variation – Supplementary Advice

Summary: In 2002, Alcoa applied to the Minister for the Environment for approval to vary the allowable level of its Wagerup Refinery noise emissions from the prescribed standard. The Environmental Protection Authority provided its advice to the Minister in Bulletin 1215 in January 2006 in conjunction with its advice on the proposed Wagerup 3 expansion.
Following the announcement by Alcoa in late 2008 that Wagerup 3 would be delayed, and after consideration of a Noise Reduction Study, the EPA developed a Proposed Strategy for Assessment of Alcoa's Noise Regulation 17 Application. Essentially the Strategy involves a change of emphasis from engineering noise reduction to noise amelioration through purchase of noise-affected properties and noise insulation of dwellings. The Strategy was put out for stakeholder comment in mid-2009 and was discussed with the Wagerup Tripartite Group. Following this process, the EPA now provides advice supplementary to advice of 2006. The EPA recommends the granting of a noise regulation 17 approval along the lines of the Strategy, that is for a two-year period in which Alcoa must use best endeavours to purchase the remaining noise-affected properties.

Australind Plant Noise Regulation 17 Variation

Summary: Millennium Inorganic Chemicals Ltd (MIC) manufactures titanium dioxide pigments for the coatings and plastics markets. MIC's Australind Plant, located at Lot 4 Old Coast Road, was established in 1963. However, since operations started, residential density has increased with the nearest residents in Laura Avenue only 150 metres from the northern plant boundary. The company considers that the proximity of neighbours made it unlikely that its noise emissions could practicably comply with the prescribed noise limits. This report presents the EPA's formal advice on the application under noise regulation 17(3)(b)(ii).

Carnarvon Power Station Noise Regulation 17 Variation

Summary: Horizon Power has already implemented a noise control programme on Carnarvon Power Station at a cost of about $5 million, which has involved extensive plant modifications and noise shielding. As a result, the noise emission levels from this power station have been reduced by between 7.6 and 13.2 dB at the neighbouring residences. However, due to the proximity of residences, the noise emissions from the power station still can not comply with the noise regulations.
